This terms below are agreed between the Trust and the Student (represented by the person named in the Starter Pack Payment Form
WHEREAS
(A) the Trust is a registered charity committed to creating music-making opportunities for young people in its local community.
(B) As part of its charitable activities, the Trust has arranged for an experienced music tutor it believes to be suitably qualified (hereinafter referred to as the “Tutor”) to provide instrumental tuition to eligible students who have applied to the Trust seeking such tuition.
(C) The Tutor has been appointed in accordance with the Trust’s Safeguarding Policy 2025 (as updated from time to time) and will be as listed in the Schedule to this Agreement.
(D) The individual named above (hereinafter referred to as the “Student”) represented by their Parent/Guardian, wishes to participate in a series of five (5) 30-minute instrumental lessons provided by the Tutor.
In consideration of the mutual covenants and agreements contained herein, the Parties agree to the following terms and conditions governing the provision of lessons and the loan of the instrument:
1. Lesson Provision
a. The Trust will provide that the Tutor will deliver five (5) 30-minute instrumental lessons at times and dates mutually agreed between the Tutor and the Student upon in advance. It is expected that lessons will be weekly, and in any case, the final lesson will take place no longer than eight (8) weeks after the first lesson. The period of time between the first lesson and the final lesson shall be referred to as the “Hire Period”.
b. Lessons will be delivered in person at a place and time as agreed between the Tutor and the Student.
c. The Tutor reserves the right to reschedule lessons due to illness, emergency, or unforeseen circumstances. In such cases, the lesson will be rearranged at a mutually convenient time.
d. Lessons will be conducted in a professional, respectful, and inclusive environment, with content tailored to the Student’s age, ability, and musical goals.
2. Student Responsibilities
a. In consideration of the lessons and loan of the Instrument under clause 3, the Student will pay to the Trust a sum of thirty (30) pounds via the Stripe Payment screen provided to it for this purpose
b. The Student agrees to attend all scheduled lessons punctually and with appropriate materials as advised to them by the Tutor.
c. If the Student is unable to attend a scheduled lesson, a minimum of 24 hours’ notice must be provided by the Student to the Tutor. Failure to do so may result in the lesson being forfeited without refund.
d. Persistent lateness or non-attendance may result in termination of this agreement.
3. Instrument Loan Terms
a. The term “Instrument” as used in this agreement includes the musical instrument provided by the Trust for use by the Student and all applicable accessories and case and as further described in the Schedule to this agreement.
b. The Instrument is loaned to the Student solely for the purpose of participating in the Lessons and for practice between sessions during the Hire Period.
c. The Instrument remains the property of the Trust and must be returned in good condition at the end of the lesson series or upon request.
d. The risk of loss, theft, damage or destruction of the Instrument shall pass to the Student upon delivery at the first lesson between the Student and the Tutor.
e. The Instrument shall remain at the Student’s sole risk during the Hire Period until such time as the Instrument is returned to the Tutor.
f. The Student shall, during the Hire Period:
i. keep the Instrument in the same condition as it was when the Student took possession of it (including replacement of strings, rosin, reeds and cork grease, as may be appropriate);
ii. not attempt or undertake any repairs to the Instrument but you must (as soon as practicable) notify us of the damage to the Instrument so that we can assess the extent of the damage and take specialist advice (if necessary) as to the repair required.
iii. not hire or sell the Instrument; nor do any other act or thing which will or may jeopardise our title in the Instrument;
iv. take appropriate care of the Instrument when in transit and ensure that the Instrument is not left unattended at any time;
v. Return the Instrument and all accessories supplied by the Trust (eg case, bow, rosin, oil etc) to the Tutor at the end of the Hire Period or on earlier termination of this agreement to Tutor at the agreed date and time.
vi. If the Instrument is damaged during the Hire Period, you agree to pay to us, on demand, the full costs of any repairs we are required to make to repair the Instrument or, in the event of total loss of the Instrument or your failure to return the Instrument at the end of the Hire Period, our costs of obtaining a replacement instrument similar to the Instrument provided up to the value indicated in the Schedule.
